Terms of Sale
At The Canada Pharmacy Store, all purchases are subject to our Terms of Sale, which ensure a transparent and reliable shopping experience. By placing an order, customers agree to comply with our policies regarding prescriptions, payments, shipping, and returns. We are committed to fair practices that protect both our customers and our services.
Canada Pharmacy Store (“Canada Pharmacy Store,” “CPS,” “we,” “our”) works with authorized pharmacies in Canada and internationally (each, a “Pharmacy”) to facilitate purchases of prescription medications and related products and services (collectively, the “Products”). Canada Pharmacy Store is a marketing and facilitation service; it is not a pharmacy and does not itself sell, dispense, or ship prescription medications. These Terms of Sale (the “Terms”) govern the relationship between you (the “Customer”) and the Pharmacy with respect to the purchase of Products, and describe the limited agency services Canada Pharmacy Store provides in support of that purchase.
By placing an order or accepting delivery of Products described in a purchase order (an “Order”), the Customer agrees to be bound by these Terms.
Universal Application of Terms
THESE TERMS APPLY TO ALL CURRENT AND FUTURE TRANSACTIONS FOR PRODUCTS PURCHASED FROM A PHARMACY THROUGH CANADA PHARMACY STORE’S FACILITATION SERVICES. IF YOU DO NOT AGREE, CANADA PHARMACY STORE CANNOT ACT AS YOUR AUTHORIZED AGENT TO FACILITATE ANY PURCHASES. IF YOU HAVE ALREADY RECEIVED PRODUCTS AND DO NOT AGREE TO THESE TERMS, YOU MUST CONTACT CANADA PHARMACY STORE WITHIN 30 DAYS USING THE CONTACT INFORMATION PUBLISHED ON canadapharmacy.store TO ARRANGE A RETURN WHEN ELIGIBLE UNDER THESE TERMS.
Personal Examination; Valid Prescription
The Customer confirms that they have attended a personal medical consultation, have undergone a physical examination by a duly licensed prescriber (the “Prescribing Practitioner”) within the previous 12 months, and presently do not require an additional examination for the prescribed medication.
Original Prescription Required. Canada Pharmacy Store or the Pharmacy will not accept or process any Order unless an original prescription is provided. The original prescription must be delivered to Canada Pharmacy Store or the Pharmacy by the Customer, or transmitted directly to Canada Pharmacy Store or the Pharmacy by the Prescribing Practitioner via an acceptable secure method.
Limited Agency Authorization (Power of Attorney)
By submitting an Order, the Customer authorizes and appoints the Pharmacy—and, solely for facilitation purposes, Canada Pharmacy Store—as the Customer’s limited agent and attorney‑in‑fact to:
(a) take steps necessary to obtain a valid prescription corresponding to the medication requested (including contacting the Prescribing Practitioner);
(b) package, arrange for dispensing by the Pharmacy, and deliver the Products to the Customer; and
(c) collect, use, and disclose the Customer’s personal and personal health information to Canada Pharmacy Store, the Pharmacy, the Prescribing Practitioner, and other health professionals retained on the Customer’s behalf, as required to fulfill the Order and comply with applicable law.
This authorization remains in effect until revoked by the Customer in writing; revocation will not affect actions already taken in reliance on the authorization.
Orders; Prices; Payment; Interest
Canada Pharmacy Store may collect Order details and/or payment on behalf of the Pharmacy. Orders are not binding on Canada Pharmacy Store or the Pharmacy until accepted in writing by the Pharmacy (directly or via Canada Pharmacy Store). Product prices are set by the Pharmacy and reflected on canadapharmacy.store at the time the Pharmacy accepts the Order. Prices may change without notice.
Unless otherwise stated in writing, payment must be received before Order acceptance. Accepted methods may include credit/debit card, wire transfer, bank draft, personal cheque, or money order. If the Pharmacy (implemented through Canada Pharmacy Store) extends credit terms, invoices are due within 30 days of the invoice date. Amounts not paid when due accrue interest at 18% per annum (or the maximum allowed by law, if lower).
Shipping Charges; Taxes
In some cases, Canada Pharmacy Store issues invoices on a Pharmacy’s behalf. Shipping and handling charges, if any, will be shown separately. The Customer is responsible for all applicable sales, use, goods and services, value‑added, or other taxes associated with the Order, as required in the jurisdiction of sale; applicable taxes will be identified on the invoice when required by law.
Delivery; Risk of Loss; Delays
Title and risk of loss pass to the Customer when the Products leave the Pharmacy. After that point, the Pharmacy, as the Customer’s agent, will arrange shipment to the Customer’s designated address.
Typical transit time is 14–21 days. If the shipment is delayed beyond 28 days, the Customer must notify Canada Pharmacy Store; upon such notice, Canada Pharmacy Store will coordinate with the Pharmacy to arrange a replacement shipment, and the Pharmacy will re‑deliver and re‑ship the Product. Canada Pharmacy Store is not liable for delays in shipment or for failure of the shipment to arrive within 28 days.
Warranties; Remedies
THE MANUFACTURER OF EACH PRODUCT IS SOLELY RESPONSIBLE FOR ANY APPLICABLE PRODUCT WARRANTY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANADA PHARMACY STORE AND THE PHARMACY DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. THE CUSTOMER’S EXCLUSIVE REMEDY FOR CLAIMS RELATING TO THE PRODUCTS IS REPLACEMENT OF THE PRODUCT BY THE PHARMACY.
Privacy
By submitting an Order, the Customer confirms that all personal information provided is accurate and consents to its collection, use, and disclosure for Order processing, verification, fulfillment, customer service, and compliance as described in Canada Pharmacy Store’s Privacy Policy available on canadapharmacy.store. Canada Pharmacy Store may amend its Privacy Policy from time to time by posting an updated version on its website. The Customer agrees to review the Privacy Policy prior to each Order.
Returns and Refunds
Due to safety and regulatory requirements, dispensed medications are not returnable and no credit will be issued, unless: (i) the Products were dispensed in error contrary to the prescription; or (ii) a delivery error occurred. Canada Pharmacy Store may amend its Return & Refund Policy from time to time by posting an updated policy on its website. The Customer agrees to review that policy before submitting each Order.
Recalls
Canada Pharmacy Store maintains a Recall Policy. Refer to the Recall Policy for details on how recalls are handled. Canada Pharmacy Store may amend its Recall Policy from time to time by posting an updated version on its website. The Customer agrees to review the Recall Policy before submitting each Order.
Product and Service Changes
The Pharmacy and Canada Pharmacy Store may revise or discontinue Products or services displayed on the website at any time without prior notice.
Export, Import, and Regulatory Compliance
Not all services displayed on the website are available in all provinces or outside Canada. U.S. regulatory authorities have stated that most importations of prescription drugs by U.S. customers from international pharmacies may violate U.S. law. By placing an Order, the Customer represents and warrants to Canada Pharmacy Store and the Pharmacy that the sale, delivery, and shipment of the Products do not violate any import, export, customs, pharmacy, or other law or regulation in the Customer’s jurisdiction. The Customer is the importer for any cross‑border shipments and is responsible for compliance, filings, duties, and taxes.
Entire Agreement
These Terms, together with any documents expressly incorporated by reference, constitute the entire agreement among the Customer, Canada Pharmacy Store, and the Pharmacy with respect to the subject matter hereof, and supersede all prior or contemporaneous agreements, proposals, negotiations, and communications, whether oral or written. In the event of a conflict between these Terms and any incorporated document, these Terms control.
Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
Headings
Headings are for convenience only and do not affect interpretation.
Force Majeure
Canada Pharmacy Store will not be liable for any delay or failure in performance due to causes beyond its reasonable control, including without limitation backorders, postal or carrier delays, customs inspections or holds, regulatory actions, supply shortages, or lost shipments. Canada Pharmacy Store has no obligation to notify the Customer of such events; the Customer is responsible for arranging alternate purchases where necessary and bears any associated costs.
Governing Law; Place of Sale
Canada Pharmacy Store is a Canadian business. Title to the Products passes from the Pharmacy to the Customer when the Products leave the Pharmacy. Agreements with a Pharmacy are deemed made in the jurisdiction in which the sale occurs, and the laws of that jurisdiction have exclusive authority over disputes between the Customer and the Pharmacy. Any disputes between the Customer and Canada Pharmacy Store will be governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein, and the parties attorn to the courts of Manitoba.
Knowledge and Consent
By placing an Order, the Customer acknowledges having read, understood, and agreed to these Terms, and that the Customer’s consent is given freely and without undue influence. The Customer acknowledges that these Terms are available on a 24‑hour basis from canadapharmacy.store and will be provided in hard copy upon request. The Customer has had the opportunity to obtain independent legal advice.Last Updated: September 11, 2025
